What you are getting

EverConvert is an AI head of growth called Eric. He measures how people move through your website, connects that to the tools you already use, tells you where you are losing money, and prepares improvements for you to approve. He works in Slack and on meeteric.ai.

Eric is in early access. That means the product is improving weekly, some parts are newer than others, and a screen you saw last month may look different this month. Where something is not ready, we say so on the screen rather than pretending.

Your account

Connecting Slack creates your account using the email address on your Slack profile, and signs you in. Keep that access to yourself; anyone who can post in your Slack channel can ask Eric for your numbers. Tell us straight away if you think someone has got in who should not have.

You need to be old enough to enter a contract where you live, and you need the authority to agree to this on behalf of the business you are using it for.

The website you connect

By connecting a website you are telling us three things, and we rely on them:

• It is yours, or you are allowed to add tracking to it on behalf of whoever owns it.
• You have a lawful basis for measuring your visitors, and your own privacy notice tells them what is collected. Our privacy page lists everything the tag sends so you can describe it accurately.
• Where the law where your visitors live requires consent before measurement, you will get it. The tag can be held back until you have it, and the privacy page explains how.

The same goes for any account you connect — Google Tag Manager, Shopify, Stripe, Google Analytics and the rest. Connect accounts you are entitled to connect.

What Eric will and will not do on his own

Eric reads, measures and proposes. He does not change your website, your ads or your funnels without you saying yes. When an install puts a tag on your site, that is the one thing you asked for and nothing else is touched — one tag, on the pages you chose.

You can turn on more autonomy for particular kinds of work. When you do, the thing you approved is the thing he may do, and every action he takes is recorded where you can see it and undo it.

His suggestions are suggestions. They come from your numbers and they are usually right, but you know things about your business that are not in the data. The decision stays yours, and so does responsibility for what you approve.

Who owns what

Your data stays yours. Your website events, what you tell Eric about your business, and everything we pull from the tools you connect belong to you. We hold it to run the product for you. Ask for a copy and you get one; ask us to delete it and we delete it.

We use it to operate and improve the product for you, and we never sell it. We do not train shared models on your raw events, your messages or your customers’ words. What Eric learns specifically about your business stays in your workspace and is deleted with it. Separately, aggregated and irreversibly anonymised patterns — the kind where no customer and no visitor can be picked out — may be used to make Eric better for everyone; the data processing terms explain exactly where the line sits, and you can ask to be left out.

When we handle your visitors’ and customers’ personal data, we do it as your processor under the data processing terms, which form part of this agreement.

The product stays ours. EverConvert, Eric, the software, the interface and the name are ours. You get the right to use them while your account is open. Do not copy the product, take it apart to rebuild it, or resell access to it.

Using it fairly

Do not:

• Put the tracking code on a site you do not have the right to.
• Use Eric to collect special category data — health, beliefs, biometrics — or children’s data.
• Send us other people’s personal data you have no basis to hold.
• Attack, overload or probe the service, or work around its limits.
• Use it for anything illegal, or to break the terms of a platform you connect.

There are rate limits in a few places to keep the service standing up. They are not there to ration you; if you hit one legitimately, tell us and we will raise it.

Paying

Early access may be free, discounted or invited. When a plan has a price, it is shown before you agree to it, and payments are taken by Paddle as our reseller — your card details go to them and never reach us.

Subscriptions renew until you cancel, and you can cancel any time; you keep what you have paid for until the end of that period. Where the work Eric does costs us money to deliver, the usage that counts is shown to you inside the product before you spend it.

The tools in the middle

Eric works through other companies’ products: Slack, Google, Shopify, Stripe and others. Each has its own terms with you, and each can change what it allows. If one of them removes something Eric depends on, we will find another way or tell you plainly that we cannot. We are not responsible for their outages, their pricing or their decisions.

Uptime, and honesty about it

We work to keep Eric up and we watch it, but early access comes with no uptime guarantee. If something breaks badly we will say so rather than leaving you to guess, and we will not quietly show you stale numbers as if they were fresh.

The service is provided as it is. We do not promise it will find every problem on your site or that any particular improvement will make you money. Nobody honest could.

If something goes wrong

Neither of us is liable to the other for lost profits, lost revenue or indirect losses. Our total liability to you for any claim is limited to what you have paid us in the twelve months before it arose, or £100 if that is more. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Ending it

You can stop whenever you like: cancel in the product or email us. Closing your account deletes your workspace and the data in it, and removes Eric from your Slack. Deleting the tracking tag from your site is your last step, and we will tell you exactly which one it is.

We may suspend or close an account that is breaking these terms, being used to harm someone, or not being paid for. Except where something is seriously wrong, we will tell you first and give you a chance to put it right.

Changes to these terms

We will date this page when it changes and tell you in Slack when the change matters. If you keep using Eric afterwards, that is your agreement to the new version. If you would rather not, close your account and we will refund anything you have paid for time you have not had.

Which law, and which courts

This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer rather than a business, you keep the protection of the mandatory laws of the country you live in, and nothing here removes your statutory rights.

If any part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something once does not mean we have given it up. You may not transfer this agreement without our agreement; we may transfer it if the business is sold, and will tell you.
